Copyright & DMCA Policy
How we handle reports of copyright infringement under the Digital Millennium Copyright Act.
Social9 respects intellectual property rights and expects its customers to do the same. Customers are responsible for having the rights to everything they publish through Social9, including images, video, music and text. This policy explains how rights holders can report infringement, as provided by the Digital Millennium Copyright Act (17 U.S.C. § 512).
1. Content Already Published on a Platform
Once Social9 publishes a post, it is hosted by the social media platform, not by Social9. To have published content taken down, please report it to that platform directly using its copyright reporting process. You can also notify us, and we will act on the content and account within Social9.
2. Filing a Notice of Infringement
Send a written notice to our designated copyright agent that includes:
- Your physical or electronic signature
- Identification of the copyrighted work you believe has been infringed
- Identification of the infringing material, with enough detail for us to locate it, such as a link or screenshot
- Your name, address, telephone number and email address
- A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent or the law
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act on the owner's behalf
Knowingly misrepresenting that material is infringing can make you liable for damages under 17 U.S.C. § 512(f).
3. Designated Copyright Agent
Copyright Agent, Social9, Inc.
201 Spear St, San Francisco, CA 94105, United States
Email: [email protected] (subject: "Copyright Notice")
4. Counter-Notice
If you believe material was removed by mistake or misidentification, you may send a counter-notice that includes:
- Your physical or electronic signature
- Identification of the material removed and where it appeared before removal
- A statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification
- Your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the United States, any judicial district in which Social9 may be found), and that you will accept service of process from the person who filed the original notice
We will forward the counter-notice to the original complainant. Unless they tell us within 10 business days that they have filed a court action, we may restore the material within 10 to 14 business days.
5. Repeat Infringers
We close the accounts of customers who repeatedly infringe copyright, in appropriate circumstances, as described in our Acceptable Use Policy.
6. Trademarks and Other Rights
To report trademark infringement, impersonation or other rights violations, email [email protected] with "Rights Report" in the subject and the details of your claim.
